On July 25, 2013, the Vachon Law Firm filed a lawsuit in California’s San Diego County Superior Court against Value Cars, Inc., a well-known National City, California used car dealership. The lawsuit alleges that Value Cars, Inc. has an illegal practice of failing to disclose accident damage sustained by the used cars that it sells to the public. The suit is titled Williams, et al v. Value Cars, Inc., et al. (San Diego County Superior Court Case No. 37-2013-00059637).
Allegations in the Complaint Against Value Cars, Inc.
The Plaintiffs in the Williams v. Value Cars, Inc. lawsuit are consumers who reside in Laughlin, Nevada and Colton, California, and who together purchased a used 2005 BMW 330ci from Value Cars, Inc. The Plaintiffs are represented by the Vachon Law Firm, which specializes in accident-damaged used car cases.
In the Complaint, the Plaintiffs allege that they visited the defendant at its National City, California dealership lot in November, 2011. The Plaintiffs go on to allege that while there Value Cars, Inc.’s representatives showed them the BMW 330ci and told them that the used car had been “thoroughly inspected,” was in “excellent mechanical condition,” and had a “clean Carfax vehicle history report.” The Complaint alleges that, based on Value Cars, Inc.’s representations about the vehicle, Plaintiffs purchased the BMW 330ci.
The Plaintiffs contend that after they purchased the BMW 330ci, they learned for the first time that the used car had previously been in a serious accident in which it had sustained frame damage. They allege in the Complaint that Value Cars, Inc. knew about the prior accident damage, but that the dealership deliberately concealed and failed to disclose the existence of the damage to the Plaintiffs.
Based on these allegations, the Plaintiffs’ Complaint alleges causes of action for violation of California’s Consumers Legal Remedies Act, common law fraud, breach of implied warranty under California’s lemon law, and unfair competition. Please note that Value Cars, Inc. denied the allegations in the Complaint, denied that it failed to disclose any known accident damage, and asserts that its actions were entirely legal. The San Diego County Superior Court has not yet ruled on whether the Complaint’s allegations are true.
