The Vachon Law Firm is pleased to announce the successful resolution of the Harris v. Universal City Nissan lawsuit (Los Angeles County Superior Court Case No. (Case No. BC5067890).
In the lawsuit, the Plaintiff, a Los Angeles, California consumer, alleged that Universal City Nissan illegally repossessed a new 2013 Nissan Versa that she had previously purchased from the dealership, even though she was not behind on her payments and had not otherwise defaulted her purchase contract.
The Vachon Law Firm, on the Plaintiff’s behalf, filed a Complaint in the Los Angeles County Superior Court asserting causes of action for conversion, common law fraud, unlawful business practices, and violation of California’s Consumers Legal Remedies Act. The Court ordered the case to arbitration, and the parties thereafter initiated an arbitration proceeding administered by JAMS.
The parties settled the matter in November 2013 pursuant to a mutually-acceptable settlement agreement in which no party made any admissions about the merits of the Plaintiff’s legal claims, and which mandates that its financial terms are confidential.
